Homeschools Incorporated a Nevada Nonprofit Corporation, Doing Business As, Southern Nevada Homeschool Association (“SNHA”)

These Terms and Conditions (“Terms”) govern your access to and use of this website and participation in all programs, memberships, workshops, field trips, events, and services operated by Homeschools Incorporated, a Nevada nonprofit corporation, doing business as Southern Nevada Homeschool Association (“SNHA,” “we,” “our,” or “us”).
By accessing the website or registering for any SNHA program, you agree to be legally bound by these Terms.
1. Legal Entity & Corporate Shield
Southern Nevada Homeschool Association is the registered trade name (DBA) of Homeschools Incorporated, a nonprofit corporation organized under the laws of the State of Nevada.
All agreements, payments, waivers, and registrations are entered into with Homeschools Incorporated.
No director, officer, board member, volunteer, instructor, contractor, or representative shall have personal liability for organizational obligations except in cases of proven gross negligence or willful misconduct.
2. Comprehensive Assumption of Risk
Participation in SNHA programs involves inherent risks including, but not limited to:

Cooking and kitchen-related injuries (cuts, burns, allergic reactions)

Physical activity injuries

Outdoor and field trip hazards
-
Equipment use risks
-
Travel-related risks
-
Exposure to communicable illnesses
-
Third-party venue conditions
By registering, you:

Voluntarily assume all risks known and unknown

Accept full responsibility for your own and your child’s participation

Agree that participation is entirely voluntary

3. Release and Waiver of Liability
To the fullest extent permitted under Nevada law, you hereby release, waive, discharge, and covenant not to sue:

Homeschools Incorporated
-
Southern Nevada Homeschool Association
-
Its directors, officers, board members
-
Volunteers, instructors, assistants
-
Independent contractors
-
Partner venues
for any claims arising from participation, including personal injury, illness, property damage, loss, or death, except where caused by gross negligence or willful misconduct.
4. Indemnification
You agree to indemnify, defend, and hold harmless Homeschools Incorporated and all affiliated persons and entities from any claims, demands, damages, liabilities, costs, or attorney’s fees arising from:

Your participation

Your child’s participation
-
Violation of these Terms
-
Negligent or intentional acts by you or your child

5. Arbitration Agreement (Binding)
Any dispute, claim, or controversy arising out of or relating to:

Website use
-
Membership
-
Event participation
-
Field trips
-
Workshops
-
These Terms
shall be resolved exclusively through binding arbitration in Clark County, Nevada.
Arbitration shall be conducted pursuant to the rules of a recognized arbitration provider mutually agreed upon by the parties.
You waive the right to a jury trial.
6. Mandatory Pre-Arbitration Mediation
Before initiating arbitration, the parties agree to first attempt to resolve disputes through good-faith mediation in Clark County, Nevada.
Each party shall bear its own mediation costs.
7. Class Action Waiver
You agree that any dispute resolution shall occur on an individual basis only.
You waive any right to participate in:

Class actions
-
Collective actions
-
Representative proceedings
All claims must be brought individually.
8. Limitation of Liability
To the fullest extent permitted by Nevada law:
Homeschools Incorporated’s total liability for any claim shall not exceed the amount paid for the specific program giving rise to the claim.
Under no circumstances shall the organization be liable for:

Indirect damages
-
Consequential damages
-
Lost profits
-
Emotional distress claims
-
Punitive damages
-
9. Field Trip & Third-Party Venue Disclaimer
SNHA does not own or control third-party venues.
You assume risks associated with third-party locations, including premises liability, equipment, staff conduct, and environmental conditions.
SNHA is not liable for acts or omissions of third-party entities.
10. Transportation Disclaimer
Unless expressly stated in writing:

SNHA does not provide transportation.

Families are solely responsible for transportation arrangements.

SNHA is not liable for travel-related incidents.

11. Emergency Medical Authorization
You authorize SNHA representatives to seek emergency medical treatment if necessary.
You accept full financial responsibility for any medical care.
12. Force Majeure
SNHA shall not be liable for cancellation or interruption of services due to circumstances beyond reasonable control, including:

Weather
-
Government orders
-
Natural disasters
-
Public health emergencies
-
Venue closures
-
Instructor illness
-
13. Severability
If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.
14. Governing Law & Venue
These Terms are governed by the laws of the State of Nevada.
All arbitration and mediation proceedings shall occur in Clark County, Nevada.
15. Modification of Terms
SNHA reserves the right to update these Terms at any time. Continued participation constitutes acceptance of any modifications.
